How on earth is the Napster case in any way a parallel here? That was about already copyrighted and protected material. Social posts are so not protected that the social network platform can use public-facing user content almost any way it wants, unless the user opts out and that already assumes that one can opt out from one use or another in the first place.
People can get fired for posts on social. That hardly implies any reasonable expectation of privacy.
What is illegal is Saradas.org that straight out profits off of others' paywalled material, leading to lost revenue, financial harm and what have you.
But, I concede that I cannot, for the life of me, get in sync with common law systems, so maybe you are absolutely right in a US context, just not in a "most of the rest of the world" context.
> > I think he's mentioned that he's been into bodybuilding before, but Im not 100% sure. > > It would be funny if he is a schmoe like us, even though I agree with him on the schmoe part.
I don't think a "schmoe" is someone who is into muscular women even if they themselves don't lift. Rather, I call schmoes..schmoe when they act like socially inept creepers towards them.
Schmoe is pretty much what this guy is, he's just subtle and hides it because he thinks he's doing the women a favor by asking mostly pretty stupid questions until he's able to feel he's asked enough to ask them to flex and then he drools and fawns and makes stupid schmoe-like comments while they flex.
And yes, he does claim to have been a bodybuilder (LMFAO), bullshit!! Have another donut and tell us another one!!
If any man has interest in female bodybuilding/muscle they are getting some sexual gratification from it. No straight man on earth is that interested in women’s bodies that much without it being sexual save for maybe some bodybuilding coaches. Sounds like this guy is in the closet about being Schmoe and more than likely is just acting this way to get laid.
Benedict Arnold was an incredibly talented and courageous man who had legitimate grievances against the Continental Congress. Ryan is just some dork who's mad on the internet. I get what you're saying, but you're doing ol' Benny boy dirty with that comparison.
The terms of service of Instagram aren't laws for the legality of anything to be based on. If anything, the terms themselves can be challenged and eventually judged to be legal or illegal.
The link your provided does not refer to just sharing but "use" and not by just any one private citizen. Which is why the article mentions that legality may depend on your stated Social Media Policy.
Private citizens don't have social media policies.
The firm that put up this article doesn't cater to private citizens so their writing also reflects that reality.
I think we’ve said everything that needs to be said at this point and we’re getting into mud slinging a bit soooooo locking the thread.
There's a couple of things everybody must understand
1- ddonthespot is trying to make money off fbb.
As much as possible.
Of course GWM pisses him off, it offers free content and if it was for him there should be no free content probably, because for him this is all a business.
Youtube might seem free but it's not, publishers get paid by Youtube.
Manion from IFBB follows the same practices.
If any of these two catch you using an extract of their vídeos they'll come after you and try to ban you.
2- GWM is illegal.
You can't go to Instagram, take a pic and put it in your own website. You must first ask for permission.
So if ddonthespot complains and hates GWM he's right.
The only reason he didn't come after GWM before is probably because it gives his videos views.
Tbis is starting to go back to Lars Ulrich VS Napster kind of stuff.
